卓榮泰的鬼扯

對於未足額編列原住民禁伐補償條例所需預算、造成立法院拒審總預算僵局，卓榮泰說不排除釋憲。他說了三點原因，其中兩點是針對預算編列，但實際上這是法定預算是否應該編足的問題，所以和補償條例有關的釋憲，只有第二點。對此卓榮泰是樣說的：
「預算法第91條規定，立法委員所提法律案大幅增加歲出或減少歲入者，應先徵詢行政院意見，指明彌補資金來源；必要時，並應同時提案修正其他法律。過往類似案例皆是在立法院內部朝野有共識，且徵詢行政院取得雙方合意，確認資金來源無虞後的依法行為，無可厚非，但此次爭議顯然未履踐徵詢、確認資金來源或並同時提案修法必要的程序；難謂合法，要行政院如何依法。」

簡單的說，就是卓榮泰認為，如果立法院的修法立法涉及歲出大幅增加或歲入大幅減少，應該先徵詢行政院意見。卓榮泰認為修法不合憲的理由，是立法院修法沒有徵詢行政院意見。
這說法看起來有道理，但實則不然。首先，預算法說的是「徵詢」而不是「行政院同意」。在當初修法的交鋒過程中，行政院是有表達意見的，否則也不會有「行政院主張增至四萬」的說法了。只是行政院的意見未被立法院採納而已。

當然，憲政體制對此也不是全無解決之道，第一種方法是覆議權。憲法本文和增修條文第三條都有覆議權設計。但很顯然，行政院在法案完成修法後並未提出覆議，這在憲政運作上的意義就是「行政院接受立法院的修法」了。也就是說，行政院在修法完成了已經和立法院達成「依法行政」的共識，如今又說沒有徵詢政院所以違憲，是完全沒道理的。

第二個解決辦法，是總統的「院際糾紛協調權」。但自始至終，賴清德都沒有針對此一糾紛出面行使他的職權。換句話說，在憲政上，總統並不認為這是個院際糾紛，行政院也沒提出希望總統出面協調的請求，表示行政院也不這麼認為。那麼所謂的不合憲從何而來？

卓榮泰說的最好笑的，是說如果他當初提覆議，一定被罵得體無完膚。這意思就是說行政院為了避免被罵得體無完膚，所以決定接受這個修法。你接受修法結果卻不依法編列預算，到底是誰的問題？

卓榮泰口口收聲聲說的財政紀律，更是好笑。短編的預算只有區區15億，是說這15億編下去就會讓行政院破產嗎？老農津貼一天到晚在調漲，財源就是政府補貼，可以補貼幾百億給老農津貼，15億的原住民禁伐補助卻死都不願補足，民進黨到底在想甚麼，這裡就很清楚了。
