市長不要笑，我很認真！萬一我們違憲怎麼辦？

我要求台北市政府，依照憲法訴訟法，向憲法法庭聲請釋憲。倘若大法官宣告質詢違憲，全台炸鍋；倘若宣告合憲，為何國會不能質詢總統而議會可以質詢市長？大法官難自圓其說，或人民難以信服；倘若不受理，更讓人看破手腳，見證大法官的荒謬性。

根據憲法法庭意旨，「直接民選產生之總統與立法院，均應各自對人民負政治責任，其彼此間並無憲法上之權力從屬關係。」「總統與立法院間並無權力從屬性或負責關係之憲法權力關係」，因此，國會不能指定總統報告，更不能質詢。「立法乃屬逾越其憲法上職權，違反憲法權力分立原則」
台北市長與台北市議會，亦各自由人民選舉產生，各自對人民負政治責任，彼此間沒有權力從屬或責任關係，為何市議會可以質詢市長？

千萬不要覺得，怎麼可能違憲。畢竟多年前我們也想不到李登輝聽國大發言、綜合答覆是違憲。多年前也想不到立法院委員會設調查小組違憲。

此外，憲法法庭說偵辦中的案件，立法院亦不得有調查權。目前市議會正在進行中的台智光調查小組，可能也要即刻停止，或向憲法法庭聲請釋憲。
